An Indian group that has been formally recognized as an Indian tribe by a State

legislature or by a State commission or similar organization
legislatively vested
with

State tribal recognition authority. Recognition of a tribe by resolution only is not

acceptable.

In order for an individual to be certified by an Indian tribe as a non-member Indian artisan,

1)
the individual must be of Indian lineage of one or more members of such Indian tribe;

and,

2)
the certification must be documented in writing by the governing body of an Indian
39
tribe
or
by a certifying body delegated this function by the governing body of the
40
Indian tribe.

Any individual who can provide official documents from the government of Canada certifying
42
his/her status as Canadian Registered Indian, Metis, or Inuit.

3.
All Artist/Craftsperson members in good standing as of July 25, 1997 may retain their
44
membership providing all membership obligations are met. Should the membership of any
45
such individual lapse, that individual would be required to reapply for membership and would
46
be subject to the IACA requirements for membership in force at the time of the reapplication.

B. Retail
. Membership in this category is open to individuals who are actively engaged in the Indian
48
arts and crafts industry by selling such products to the ultimate customer for their personal use.

Retailers may operate their business from an established shop or via other venues as long as the
50
business conducted is of a retail nature as defined in the first sentence of this Section (B).
C.

Wholesale
. Membership in this category is open to:

1.
Individuals who are actively engaged in the Indian Arts and Crafts Industry by purchasing
53
goods for the purpose of reselling these products to Retailers; and
54
2.
Individuals who are actively engaged in the Indian Arts and Crafts Industry by employing
55
Indian artists/craftspeople for the purpose of producing authentic Indian products for resale to
56
Retailers.
